By accessing or using the ArmedStrong marketplace platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ArmedStrong, LLC ("ArmedStrong," "we," "us," or "our"). Your continued use of the Platform following any modifications to these Terms constitutes acceptance of those modifications.
The Platform is available exclusively to businesses and individuals holding a valid, unexpired Federal Firearms License (FFL) as issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). By registering for an account, you represent and warrant that: (a) you hold a valid FFL; (b) your FFL has not been revoked, suspended, or otherwise rendered inactive; (c) you are authorized to conduct business on behalf of the licensed entity; and (d) you will promptly notify ArmedStrong of any changes to your license status. ArmedStrong reserves the right to verify your FFL against the ATF registry at any time and to suspend or terminate your account if your license is found to be invalid, expired, or non-compliant.
To access the Platform, you must complete the registration process, which includes providing accurate and complete information about yourself and your business, submitting your FFL for verification, and completing any required identity verification procedures. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify ArmedStrong immediately of any unauthorized use of your account. ArmedStrong is not liable for any loss arising from unauthorized access to your account.
All listings on the Platform must comply with applicable federal, state, and local laws and regulations governing the sale and transfer of firearms, ammunition, and related accessories. Sellers are responsible for ensuring that all product listings are accurate, complete, and lawful. Buyers are responsible for ensuring that they are legally permitted to purchase and receive the items they order. ArmedStrong acts as a marketplace facilitator and does not take title to or possession of any products listed on the Platform. All transactions are between the buyer and seller, subject to applicable compliance requirements.
All Users must comply with the Gun Control Act of 1968, the Arms Export Control Act, all applicable regulations of the ATF, and all applicable state and local laws. Users must maintain accurate records of all transactions conducted through the Platform in accordance with ATF regulations, including Form 4473 requirements where applicable. ArmedStrong may require additional documentation or verification at any time to ensure compliance. Failure to comply with these requirements may result in immediate account suspension or termination, and ArmedStrong may report suspected violations to the appropriate regulatory authorities.
All prices on the Platform are quoted in United States Dollars. Payment terms are established between buyers and sellers, subject to ArmedStrong's payment processing requirements. ArmedStrong may charge service fees, transaction fees, or subscription fees as disclosed on the Platform. All fees are non-refundable except as expressly stated in our refund policy. ArmedStrong reserves the right to modify its fee structure upon thirty (30) days' written notice to Users.
To the maximum extent permitted by applicable law, ArmedStrong shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Platform. ArmedStrong's total aggregate liability for any claims arising out of or relating to these Terms or your use of the Platform shall not exceed the total fees paid by you to ArmedStrong in the twelve (12) months preceding the event giving rise to the claim. ArmedStrong does not guarantee the accuracy, completeness, or reliability of any information provided by Users on the Platform.
ArmedStrong reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, you must discontinue use of the Platform. It is your responsibility to review these Terms periodically for changes.
